Allard van Duijn

Allard is a lawyer specialized in patents and technology. He represents clients both before the Unified Patent Court (UPC) and the Dutch national courts. Having worked previously as a lawyer (advocaat) at Freshfields LLP, Allard has built a track record in litigating high-stakes multi-jurisdictional IP and IT cases. His experience covers technical products such as computer hardware, software, pharmaceuticals and medical devices.

Allard enjoys teamwork. He has built a strong network of other lawyers, patent attorneys and academics. This allows him to put together a tailor-made team for each case. For larger cases, Allard knows how to find good subject matter experts, co-counsel and patent attorneys.

In his spare time, Allard enjoys hiking, photography, working on electronics and programming. He is pursuing a parttime university degree in Computer Science out of personal curiosity. One of his latest personal projects was building this website.

Allard is admitted to the Dutch bar and registered as a representative before the UPC.

Experience

  • Vertex v ToolGen
    Represented plaintiff Vertex in main proceedings against ToolGen. The subject of the proceedings was the annulment of ToolGen's patent regarding CRISPR/Cas9.

  • Genentech v Roche / Organon
    Represented plaintiffs Genentech and Roche in proceedings against Organon before the Unified Patent Court (UPC). In these proceedings, evidence of patent infringement was succesfully seized at Organon's premises in the Netherlands and Belgium.

  • Synthon v Novartis
    Represented defendant Novartis in patent invalidity proceedings instituted by Synthon related to Novartis' product Entresto®.

  • Moderna v Pfizer en BioNTech
    Represented plaintiff Moderna in main proceedings against Pfizer and BioNTech regarding infringement of Moderna's patents on COVID-19 vaccines.

  • Grünenthal v Teva
    Represented plaintiff Grünenthal in preliminary relief proceedings against Teva regarding infringement of Grünenthal's patent related to a testosterone product.

  • Samsung Bioepis v Novartis
    Represented defendant Novartis in patent invalidity proceedings instituted by Samsung Bioepis.

  • Huisman Equipment v Mammoet Holding
    Represented plaintiff Huisman Equipment in preliminary relief proceedings instituted against Mammoet Holding regarding an unlawful press publication.

  • Philips Domestic Appliances Holding v Anheuser-Busch Inbev
    Represented defendant Anheuser-Busch Inbev (AB Inbev) in preliminary relief proceedings instituted by Philips Domestic Appliances Holding (PDAH) regarding alleged patent infringement.

  • Corbin Clinical Resources v Advance Medical Designs
    Represented defendant Advance Medical Designs in preliminary relief proceedings instituted by Corbin Clinical Resources regarding alleged patent infringement related to a medical device for prostate biopsy.

  • Novartis v Pharmathen Global
    Represented defendant Novartis in an enforcement dispute initiated by Pharmathen Global regarding the forfeiture of penalty payments. Both at first instance and on appeal, the ruling was in favor of Novartis, and Pharmathen forfeited €7.5 million in penalty payments.

  • Novartis v Mylan
    Represented defendant Mylan in preliminary relief proceedings instituted by Novartis regarding alleged patent infringement related to fingolimod.

  • Hewlett Packard Enterprise v PTP IT Distribution
    Represented plaintiff Hewlett Packard Enterprise (HPE) in evidence seizure proceedings regarding trademark infringement related to server hardware and software licenses.

  • I.P.V. Delft v X
    Represented plaintiff I.P.V. Delft in main proceedings regarding copyright and slavish imitation related to street art.
